Terms and Conditions of Use

By accessing or using the multitour.io platform (the “Platform”), you express your agreement with these Terms and Conditions (“T&C”), together with the Privacy Policy. If you do not agree, do not use the Platform.

These terms constitute a legal agreement between you (the “User” or the “Agency”) and MULTITOUR SRL, with its registered office at Bulevardul Regina Elisabeta 7-9, Room 12, Floor 2, 030016, Bucharest, CUI 54200644 (“Multitour”, “we”).

Use of the Platform is permitted exclusively to legal entities (travel agencies, sole traders, family businesses) and their adult representatives (at least 18 years old) with full legal capacity to enter into contracts.

Multitour provides a software platform accessible over the internet (SaaS) that includes:

• Tourscanner — a search and comparison engine for holiday offers from partner tour operators.
• Travel CRM — a system for managing the agency's relationship with its end clients (clients, requests, bookings, communication).

The Platform is provided “as is”, in its current stage of development. Multitour may add, modify or remove features with notice to users.

Registration

To access the Platform, the Agency must create an account by providing accurate, complete and up-to-date information. The Agency is responsible for the accuracy of the data provided at registration.

Account security

The Agency is responsible for:

• Keeping its login credentials (email and password) confidential.
• All actions carried out through its account.
• Notifying Multitour immediately at info@multitour.io in the event of unauthorized access.

Multitour cannot be held responsible for losses caused by unauthorized use of the account if the Agency has not taken reasonable protective measures.

Trial / beta period

Multitour may offer free access to the Platform for a trial period or as part of the beta program. When the trial period expires, access is conditioned on the activation of a paid subscription. Multitour reserves the right to modify or terminate the trial program with at least 7 days' prior notice.

Pricing and subscriptions

The available subscription prices, periods and accepted payment methods are displayed in the Agency's account and on the multitour.io platform. Multitour may change prices with at least 30 days' notice to the Agency before they take effect.

Payment and activation

Access to the paid features of the Platform is conditioned on advance payment of the subscription. Access is activated automatically after payment confirmation and is suspended automatically when the paid period expires, without further notice.

Consequences of non-payment

In case of non-payment when due, Multitour has the right to restrict or suspend access to the Platform without any prior notice beyond the displayed payment term.

Refund policy

We offer a pro-rata refund if you cancel within the first 7 days of the paid period.

Invoicing

Invoices are issued in accordance with Romanian tax legislation. The Agency confirms that the billing details provided are correct and assumes tax responsibility for any inaccuracy communicated.

Acceptable use

The Agency undertakes to use the Platform solely for lawful purposes, in connection with its activity as an authorized travel agency, and in accordance with these T&C.

Prohibitions

It is strictly forbidden to:

• Access or attempt unauthorized access to other users' accounts or to Multitour's infrastructure.
• Use the Platform for fraudulent activities, spam, disinformation or any illegal activity.
• Copy, disassemble, decompile or modify any component of the Platform.
• Resell or sublicense access to the Platform to third parties.
• Use bots, scrapers or automated systems to access the Platform without Multitour's written consent.
• Enter into the Platform false, misleading data or data that infringes the rights of third parties.

Responsibility for content

The Agency is fully responsible for the accuracy, legality and timeliness of any information entered into the Platform, including traveller data, bookings and any communications sent to end clients.

The offers displayed in Tourscanner come from the partner tour operators and are provided through their API connections. Multitour does not guarantee and is not responsible for:

• The accuracy, completeness or timeliness of the prices, availability, descriptions, photos or any other information provided by partner operators.
• The quality, conformity or delivery of the travel services contracted by the Agency or its travellers with the partner operators.
• Any unilateral changes to the offers made by the tour operators.

Multitour makes reasonable efforts to ensure Platform availability of at least 95% monthly, calculated excluding scheduled maintenance periods.

Multitour will notify the Agency at least 24 hours before scheduled maintenance work, except for emergency interventions. Maintenance periods are not considered service interruptions in the availability calculation.

Multitour is not responsible for interruptions caused by external factors: internet providers, third-party service providers (tour operators, external APIs), cyber-attacks or force majeure events.

The multitour.io platform, the source code, the design, the trade names, trademarks, logos and all other intellectual property elements belong exclusively to MULTITOUR SRL or its licensors and are protected by Romanian and European law in this field.

Through this agreement, Multitour grants the Agency a non-exclusive, non-transferable and limited right of use for the duration of the active subscription, solely for the purpose of carrying out the travel agency activity.

The Agency acquires no ownership right over the Platform or its components. Any use outside the purpose described above is prohibited.

To the maximum extent permitted by applicable law, Multitour is not liable for:

• Indirect, incidental, consequential or lost-profit damages of the Agency or its end clients.
• Damages resulting from the use or inability to use the Platform.
• Damages caused by errors, interruptions or temporary unavailability of the service.
• The content, accuracy or availability of the partner tour operators' offers.
• The actions or omissions of the Agency towards its end travellers.

Multitour's total liability towards the Agency, regardless of the cause or nature of the claims, may not exceed the value of the subscription paid by the Agency in the calendar month prior to the event giving rise to the damage.

Termination by the Agency

The Agency may terminate access to the Platform by written notice sent to info@multitour.io at least 30 days in advance. Access remains active until the paid subscription period expires.

Suspension or termination by Multitour

Multitour may suspend or terminate access in the following situations:

• Non-payment of the subscription when due — immediate suspension after the paid period expires.
• Serious breach of these T&C — immediate termination, with written notice.
• Use of the Platform for illegal or fraudulent purposes — immediate termination, without prior notice.
• Cessation of Multitour's activity — notice of at least 30 days.

Effects of termination

On termination of access, the Agency may request an export of its data within 30 days. After this term expires, the data may be deleted in accordance with the Privacy Policy.

Neither Party is liable for the non-performance of obligations caused by a force majeure event — an unforeseeable, insurmountable event beyond the control of the affected Party (natural disasters, armed conflicts, officially declared pandemics, acts of public authorities, major nationwide internet infrastructure failures).

The affected Party notifies the other Party within a maximum of 5 business days. If the situation exceeds 60 days, either Party may terminate the contract without penalty.

Multitour may update these T&C. Minor changes take effect upon publication. Significant changes (prices, user rights, liability limitations) are communicated to you by email at least 30 days in advance.

Continuing to use the Platform after the effective date constitutes acceptance of the new terms. If you do not agree, you may terminate access in accordance with Section 10.

These T&C are governed by Romanian law. Any dispute will be settled, in a first stage, amicably within 30 days of the written notice. If this fails, the dispute will be referred to the competent courts at the registered office of MULTITOUR SRL, Bucharest.

These T&C, together with the Privacy Policy and the signed service contract (if any), constitute the entire agreement between the Agency and Multitour regarding the use of the Platform.

If any clause is declared null or unenforceable by a competent court, the remaining clauses remain valid in their entirety.

The notices provided for in these T&C are sent by email to the addresses indicated at registration, with read confirmation.
